Terms of Service

These Terms of Service ("Terms") govern your access to and use of Katja and the website located at katjasong.com (the "Service"), operated by Katja ("Katja", "we", "our", or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. Description of the Service

Katja provides professional music editing services for athletes, coaches, choreographers, clubs, and other users requiring edited music for sports and performance activities. The Service allows users to upload audio files, provide instructions, request music edits, receive previews or completed edits, and download completed files.

Katja reserves the right to modify, suspend, or discontinue any part of the Service at any time.

Katja does not guarantee that completed edits will satisfy every subjective preference of the customer.

2. Eligibility

You must be legally capable of entering into binding agreements under the laws applicable to you.

If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian.

3. Customer Responsibility for Request Accuracy

Customers are responsible for ensuring that all submitted instructions, target durations, uploaded files, and other request details are accurate before placing an order.

Katja is not responsible for errors, delays, or dissatisfaction resulting from incorrect, incomplete, contradictory, ambiguous, or subsequently changed customer instructions.

If a request contains missing information, conflicting instructions, or other issues that prevent work from commencing, Katja may contact the customer for clarification before processing the order.

4. Audio Rights and User Content

The customer is solely responsible for ensuring that they have the necessary rights to upload and use submitted audio files.

By uploading audio files to the Service, you represent and warrant that:

• You own the content or possess all necessary rights and permissions to use it.
• The uploaded content does not infringe the rights of any third party.
• The uploaded content complies with applicable laws and regulations.

Katja does not verify ownership, licensing, or legal rights relating to uploaded content.

You remain solely responsible for all content submitted through the Service.

5. Katja Basic Orders

Katja Basic is intended for straightforward editing requests.

No payment is required unless you approve the preview.

Katja Basic does not include revisions.

If you are not satisfied with a Katja Basic preview, you may decline the preview and no payment will be charged.

Customers who require additional customization may choose to place a Katja Custom order.

6. Katja Custom Orders

Katja Custom is intended for more advanced editing requests and personalized instructions.

Payment is required before work begins.

Each Katja Custom order includes one (1) complimentary revision.

The complimentary revision may be used for reasonable adjustments to the completed edit based on the customer's original request and preferences.

Revision requests that substantially alter the original concept, music selection, structure, duration, scope, or requirements of the order may be treated as a new order and charged separately at Katja's standard rates.

Requests involving the replacement, addition, removal, or modification of uploaded audio files or audio sources may be treated as a new order and charged separately.

7. Delivery Times

Any delivery times displayed on the Service are estimates only.

Delivery times begin only after Katja has received a complete and actionable request containing all information reasonably necessary to begin work.

If a request contains missing information, conflicting instructions, or other issues requiring clarification, the delivery period will begin once the necessary information has been received.

Katja is not responsible for delays caused by incomplete or unclear customer requests.

If additional information, files, approvals, or clarifications are required from the customer before an order can reasonably be completed, delivery estimates and deadlines may be extended accordingly until the required information has been provided.

8. File Availability and Storage

Katja may make completed orders available for future downloads through the customer's account. However, Katja does not guarantee permanent file availability and reserves the right to modify, limit, suspend, or discontinue file storage and download access at any time, with or without prior notice.

Customers are solely responsible for maintaining their own backups of all delivered files.

Katja shall not be liable for any loss of access to files, deleted files, or any failure by a customer to download or back up their files.

The unavailability, deletion, or removal of previously delivered files shall not by itself entitle a customer to a refund.

9. Copyright Concerns and Order Refusal

Katja reserves the right to refuse, suspend, cancel, or terminate any order where there is a reasonable belief that the customer may not possess the necessary rights to use submitted audio materials.

If a Katja Custom order is cancelled by Katja due to an apparent copyright or rights issue before work begins, any payment received for that order will be refunded.

10. Payments

Payments are processed by third-party payment providers, including Stripe.

By making a payment through the Service, you agree to the applicable terms and policies of the payment provider.

Katja does not store payment card information.

11. Refunds

Due to the personalized nature of the Service, orders are generally non-refundable once work has begun.

For Katja Basic orders, refunds are generally not applicable because payment is only required after the customer has reviewed and approved the preview.

For Katja Custom orders, refund requests may be considered in exceptional circumstances, including:

• Technical errors;
• Duplicate payments;
• Orders cancelled by Katja before work begins;
• Situations where a refund is required by applicable law;
• Cases where, after the included revision has been completed, the final result materially deviates from the customer's original request.

Customer dissatisfaction alone does not automatically entitle the customer to a refund where the delivered work substantially reflects the original request.

Refund decisions are made at Katja's reasonable discretion.

12. Ownership of Content

Customers retain all rights to the audio files they upload.

Katja does not claim ownership of customer content or uploaded audio files.

Customers are responsible for ensuring that they have the necessary rights, licenses, or permissions to use any audio content uploaded to the Service.

13. Service Improvement and Request Data

Customer requests and revision requests submitted through the Service may be accessed, stored, reviewed, and analyzed by Katja for:

• Service delivery;
• Quality assurance;
• Service improvement;
• Product development;
• Training;
• Operational purposes;
• Business analytics.

Request and revision information may be accessed and processed by authorized employees, contractors, and service providers engaged by Katja for the purpose of delivering and improving the Service.

By using the Service, you acknowledge and agree to such use of your requests and revision requests.

14. Third-Party Services

The Service may rely on third-party providers including:

• Google Sign-In
• Stripe
• Sentry

Katja is not responsible for the availability, functionality, security, privacy practices, or policies of third-party services.

15. Prohibited Use

You agree not to:

• Upload content you are not authorized to use;
• Violate intellectual property rights;
• Use the Service for unlawful purposes;
• Interfere with the operation of the Service;
• Attempt unauthorized access to the Service or its systems;
• Submit fraudulent, misleading, or deceptive information.

16. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis.

While Katja strives to provide professionally edited music, Katja does not guarantee that any edit will satisfy every subjective preference or expectation of the customer.

To the fullest extent permitted by law, Katja disclaims all warranties, whether express or implied.

17. Limitation of Liability

To the maximum extent permitted by law, Katja, its directors, officers, employees, contractors, affiliates, and representatives shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of the Service.

Katja shall not be responsible for copyright claims, licensing disputes, competition rule violations, or other legal issues arising from customer-submitted content.

Katja shall not be liable for any loss of access to stored files, deleted files, or unavailable downloads.

Katja's total liability arising out of or relating to the Service shall not exceed the amount paid by the customer for the relevant order.

18. Indemnification

You agree to indemnify and hold harmless Katja, its directors, officers, employees, contractors, affiliates, and representatives from any claims, damages, losses, liabilities, costs, and expenses arising from:

• Your uploaded content;
• Your use of the Service;
• Your violation of these Terms;
• Any allegation that your content infringes the rights of a third party.

19. Changes to These Terms

Katja may modify these Terms from time to time.

Updated Terms become effective upon publication on the Service.

The version of these Terms in effect at the time an order is placed shall apply to that order.

Any updates to these Terms will apply only to future use of the Service and future orders placed after the updated Terms become effective.

20. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Finland.

Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Finland.
